The U.S. Supreme Court will hear historic arguments as attorneys for former President Donald Trump argue he has absolute immunity from criminal prosecution for his efforts to overturn the 2020 election. The case, Donald J. Trump v. United States, is the first time in its 235-year history the nation’s highest court has been asked to weigh in on whether a former president could be criminally prosecuted for acts committed while in office. Special Counsel Jack Smith’s office says he can – and that his efforts to remain in power after losing the 2020 election amount to a criminal conspiracy to defraud the United States and obstruct the joint session of Congress. Trump’s attorneys say he cannot, and that all of his actions amount to him, as chief executive, attempting to safeguard the election from possible fraud.
