The Morrow County Prosecutor's Office will seek the death penalty for the man accused of killing Deputy Daniel Sherrer last week if he is convicted.
Prosecutor Andrew Wick announced on Friday that a Morrow County grand jury indicted 53-year-old Brian Michael Wilson on 14 counts. Two of the counts, both of which are aggravated murder, carry specifications that make Wilson eligible for the death penalty, Wick said.
Authorities say Wilson shot and killed Sherrer on May 26. The deputy was responding to a report of a domestic situation on County Road 26 when Wilson allegedly shot him.
Below is the 14-count indictment, according to Wick:
Counts 1 and 2: Aggravated murder
Count 3: Felony murder
Count 4: Felonious assault on a peace officer
Count 5: Felonious assault on a peace officer with a deadly weapon
Count 6: Attempted murder of Wilson's brother-in-law
Count 7: Attempted aggravated murder of Wilson's brother-in-law
Count 8: Felonious assault
Count 9: Domestic violence
Count 10: Unlawful discharge of a firearm into a habitation
Count 11: Unlawful discharge of a firearm on or across a public roadway
Counts 12 and 13: Possession of criminal tools
Count 14: Discharge of firearm while intoxicated
Wilson's bond was set at $5 million earlier this week. A preliminary hearing will be set for a later date.
Body camera footage released by the sheriff’s office shows a neighbor warning Deputy Sherrer that Wilson had been drinking, arguing with family and had a gun. The video captures Sherrer approaching the home and attempting to de-escalate the situation.
Just seconds after Sherrer approached Wilson on the deck, he was shot and killed.
A memorial continues to grow outside the Morrow County Sheriff’s Office, where Deputy Sherrer's parents gathered as Wick made the announcement.
Wick urged prosecutors statewide to stand united in protecting law enforcement officers and first responders, emphasizing the need for consequences strong enough to deter future attacks.
Sherrer was laid to rest Wednesday after a visitation and celebration of life at Northmor High School. He was buried at Marion Cemetery.
Sherrer was a four-year veteran with the sheriff's office. Sheriff John Hinton said Sherrer loved his job and was a godsend for the department. He is survived by his parents and fiancé.
