A South Florida real estate company accused of trapping homeowners in 40-year listing agreements and putting liens on their homes is not properly following a court order to clear people’s property titles, the state attorney general’s office said in recent court documents.
According to an order from Hillsborough County Judge Darren Farfante, MV Realty was supposed to file terminations for all of recorded notices of its Homeowner Benefit Agreements, contracts that bind homeowners to the 40-year terms. Attorneys for the state have said those recordings in the public record cloud homeowners’ titles.
“When you place that recorded document on the house, which is a lien of public records, and that prohibits them from selling the house, prohibits them from getting a refinance. It just really ties their hands,” St. Petersburg attorney Charles Gallagher said.
“The trial court’s judgment and injunction, by its own effect, nullifies the effect of these agreements, essentially rendering them void across the board,” Gallagher added.
But new filings from the state say MV Realty is now making the cancellations conditional and has removed language that fully releases MV Realty’s stake in the property.
“It’s just unbelievable how a company can work that way and not be caught until so many people have been ruined,” Celine Davidson said.
