Description
In the biggest development since Florida’s attorney general filed its lawsuit against MV Realty in November 2022, a Hillsborough County judge ruled that the company can no longer enforce its Homeowner Benefit agreement that locked homeowners into 40-year contracts and clouded their property titles.
According to court documents, approximately 9,303 HBAs were issued in Florida between 2018 and 2022. There were 34,000 nationwide.
Under Judge Darren Farfante’s summary judgment on injunctive relief, MV Realty must also end the collection of termination fees.
The company will additionally have to record terminations of all the memoranda associated with the HBA within 14 days of the order or within two days of being notified by a homeowner or someone working on a home's sale or refinancing.
Under the HBA, the company pays homeowners up to a few thousand dollars up front in exchange for exclusive listing rights. Many homeowners said they later learned the agreements last 40 years and acted as liens against their property.
