Each year, tens of thousands of Hoosiers face eviction statewide. In 2023, landlords filed more than 71,000 eviction cases in Indiana. More than a third of those eviction proceedings involved people living in Marion County. Since the pandemic, the state and county have funneled millions of dollars into eviction diversion efforts, some of which are managed through small claims courts. Tenant advocates tell 13 Investigates now some property owners appear to be taking steps to avoid small claims courts.
Most evictions in Marion County are filed in small claims courts, where the rules are designed to be easily understood and where people can often represent themselves. Landlords have always had the option to file in Marion Superior Court. The option was rarely used. However, in 2024, tenant advocates started reporting the filings in the more expensive and rigid court ballooned.
