Description
A federal judge in New Jersey has ruled that the U.S. government cannot detain or deport pro-Palestinian activist and former Columbia University graduate student, Mahmoud Khalil, over foreign policy concerns, setting a deadline for the Trump administration to respond.
The Justice Department responded to the Khalil letter asking for his release Friday, arguing that the judge's findings earlier this week "did not order Respondents to release Petitioner Mahmoud Khalil," and said that "Khalil is charged as removable on a ground other than the Secretary of State’s determination. Detaining Khalil based on that other ground of removal is lawful."
This fits the Trump administration's arguments for the last few months that US District judges do not have the authority to release people from ICE detention. Still, that argument has not been successful upon appeal.
Judge Michael Farbiarz is expected to respond.
