Description
A federal appeals court ruled that President Donald Trump cannot use the Alien Enemies Act to carry out the expedited deportations of people accused of being Venezuelan gang members.
In March, Trump invoked the act and swiftly loaded a plane headed to El Salvador with more than 200 individuals accused of being Tren de Aragua gang members. He was met with a slew of legal challenges shortly thereafter, with this latest ruling determining the president's claims about the gang didn't meet the historical levels of conflict that Congress deemed necessary for the act to be invoked.
Before March, the Alien Enemies Act had only been invoked three times: the War of 1812 between the U.S. and Great Britain and the two world wars.
